Terms of Use

Welcome to QuizNode. These Terms of Use ("Terms") govern your access to and use of QuizNode's website, mobile applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using QuizNode, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" will refer to both you individually and the organization.

2. Account Registration and Responsibilities

To access certain features of QuizNode, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Be at least 13 years of age (or the age of majority in your jurisdiction)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. QuizNode is not liable for any loss or damage arising from your failure to comply with this section.

3. Use of the Service

QuizNode provides an AI-powered platform for creating, taking, and sharing educational quizzes. You may use our Service for personal, non-commercial purposes in accordance with these Terms.

Permitted Uses:

  • Creating and taking quizzes for educational purposes
  • Sharing quizzes with other users
  • Tracking your learning progress and performance
  • Accessing AI-generated quiz content within usage limits

Prohibited Uses:

  • Violating any applicable laws or regulations
  • Infringing upon intellectual property rights of others
  • Uploading malicious code, viruses, or harmful content
  • Attempting to gain unauthorized access to our systems
  • Using automated systems to scrape or extract data without permission
  • Impersonating others or providing false information
  • Harassing, threatening, or abusing other users
  • Using the Service for any commercial purpose without authorization
  • Circumventing usage limits or subscription restrictions
  • Reverse engineering or attempting to extract source code

4. AI-Generated Content

QuizNode uses artificial intelligence to generate quiz content. You understand and agree that:

  • AI-generated content may contain errors or inaccuracies
  • AI-generated quizzes are provided "as-is" without warranties
  • You are responsible for reviewing and verifying AI-generated content before use
  • Usage limits apply to AI generation features (free users: 1 generation/month, premium users: 100 generations/month)
  • QuizNode reserves the right to modify or discontinue AI features at any time

While we strive for accuracy, QuizNode does not guarantee the correctness, completeness, or reliability of AI-generated content. You should not rely solely on AI-generated quizzes for critical educational or professional decisions.

5. User-Generated Content

You retain ownership of any quizzes, comments, or other content you create and submit to QuizNode ("User Content"). However, by submitting User Content, you grant QuizNode a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to:

  • Use, reproduce, modify, adapt, publish, translate, and distribute your User Content
  • Display and perform your User Content in connection with the Service
  • Create derivative works from your User Content
  • Use your User Content for marketing and promotional purposes

You represent and warrant that:

  • You own or have the necessary rights to grant the license above
  • Your User Content does not infringe any third-party rights
  • Your User Content is not defamatory, obscene, or illegal
  • Your User Content does not contain personal information of others without consent

QuizNode reserves the right to remove, edit, or refuse to publish any User Content at our sole discretion, without prior notice.

6. Intellectual Property

The Service, including its original content, features, functionality, design, logos, and trademarks, is owned by QuizNode and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the Service
  • Use our trademarks, logos, or brand elements without permission
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the Service to develop competing products or services

7. In-App Purchases and Subscriptions

QuizNode offers premium features through in-app purchases and subscriptions managed by RevenueCat. By making a purchase, you agree to:

  • Payment: All purchases are processed through Apple App Store, Google Play Store, or our web payment system. You agree to pay all charges associated with your purchase.
  • Subscription Terms: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions through your device's settings or our Service.
  • Refunds: Refund policies are governed by Apple, Google, or our payment processor's terms. QuizNode does not provide direct refunds for purchases made through third-party platforms.
  • Price Changes: We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current subscription period.
  • Feature Availability: Premium features may vary by platform and are subject to change. We do not guarantee specific features will remain available.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. QUIZNODE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or quality of content
  • Warranties that defects will be corrected

QuizNode does not warrant that quiz content is accurate, complete, or suitable for any particular educational purpose. You are responsible for verifying information independently.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZNODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any conduct or content of third parties on the Service
  • Any unauthorized access to or use of our servers or data
  • Any interruption or cessation of the Service
  • Any errors or omissions in content
  • Any decisions made based on quiz results or content

IN NO EVENT SHALL QUIZNODE'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO QUIZNODE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless QuizNode, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and data
  • You remain responsible for any outstanding payments
  • Provisions that by their nature should survive termination will survive

You may terminate your account at any time by contacting us or using account deletion features in the Service.

12. Changes to Terms

QuizNode reserves the right to modify or replace these Terms at any time. If we make material changes, we will notify you by:

  • Posting the new Terms on this page
  • Updating the "Last updated" date
  • Sending an email notification (for significant changes)
  • Displaying a notice in the Service

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QuizNode operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuizNode regarding the Service and supersede all prior agreements and understandings.
